Newsok.com is reporting that a one-year old has died after being thrown from a vehicle which crashed after leaving the roadway. It doesn't say whether the child was in a child seat, but just wanted to remind parents to please put your children in safety seats when traveling. I hope and pray that each parent does this as our little ones lives can be saved if we are involved in a car crash.

Wal-Mart Cleared in Slip and Fall Lawsuit

It took a Washington County jury less than thirty minutes, Tuesday, to decide Wal-Mart Stores Inc. was not at fault for a slip-and-fall accident that happened last year.

The suit sought damages for an accident at its Sixth Street store located in Fayetteville on June 24. The claim alleged the man suffered neck injuries and pain resulting from the fall, with medical bills totaling $11,735.

Security video did not capture the fall, but it did show that two orange caution cones were in place with a "caution wet floor" sign, at the time of the fall. He waited 20 minutes before filling out an accident report, after calling and consulting with his father.

His father is a Fayetteville attorney who specializes in personal injury cases. He pointed out that the chiropractor that the plaintiff went to for treatment also handles patients who are clients of his father. Wal-Mart's attorney also told the jury that his general medical doctor refused to give him medication for his alleged injury because he was already under a "pain contract."

Originally posted at InjuryBoard by Chrissie Cole

Bayer Pharmaceuticals Removes Remaining Stocks of Trasylol

Bayer HealthCare Pharmaceuticals has notified the FDA that the company has begun removal of remaining Trasylol from the U.S. market, which includes mostly hospitals, warehouse or physician's stock. Bayer and the FDA are working together to ensure a smooth transition.

Under a limited use agreement, Trayslol is limited to investigational use of the drug according to the procedures outlined in a special treatment protocol which allows for certain patients who are at increased risk of blood loss during coronary artery bypass graft surgery and have no other alternative therapy options. Doctors who use this option must also verify that the benefits clearly outweigh the risk to their patient.

The FDA limits access to certain drugs, such as Trasylol, to patients with serious or life threatening disease or conditions who lack other medical options who may benefit from such therapies. This type of access requires the submission of protocol which is then reviewed and approved by the agency. Bayer has agreed to provide Traysylol the limited use above.

Trasylol Background: On November 5, 2007 the U.S. Food and Drug Administration announced that Bayer agreed to an FDA-requested marketing suspension of Trasylol, a drug to control bleeding during heart procedures. At that time, preliminary results from a Canadian study suggested increased risk of death compared to two other drugs used for the same purpose included in the study.

Originally posted at InjuryBoard by Chrissie Cole

Man Injured in Tractor-Trailer Accident

A tractor-trailer accident involving two semi trucks on U.S. Highway 75 near Ochelata, on Tuesday, sent one man to Tulsa Hospital.

The crash aftermath blocked the northbound lanes of the highway for more than two hours according to Washington County Sheriff's Office.

While the names of those involved in the accident have not been released, authorities have said the drivers were both males. A medical helicopter airlifted one of the victims to a Tulsa Hospital.

A semi tractor-trailer was pulling out of a truck stop when it was struck in the rear by a northbound "PODS" storage truck at about 3 p.m. The driver of the PODS truck was pinned for quite a while, according to police. Ochelata fire and Oglesby fire were able to release him.

Oklahoma Highway Patrol is investigating the accident. Oglesby, Ochelata and Ramona fire departments along with Bartlesville Ambulance Service and Washington County Sheriff's Office all responded to the scene.

Originally posted at InjuryBoard by Chrissie Cole

Family Files Wrongful Death Lawsuit in Indiana Mining Accident

The family of a man who plunged 500 feet to his death in a coal mine air shaft has filed a wrongful death lawsuit, in U.S. District Court seeking $9.5 million in damages, against the company he helped found that was building the shaft.

The suit alleges Frontier-Kemper Constructors Inc. was negligent in providing safety measures for the man, 66, and two other men who fell from a construction bucket during an August tour of the mining shaft.

The complaint says Frontier-Kemper failed to provide safety belts or harnesses as fall protection, and that a 20-foot nylon sling and shackle attached to the bottom of the bucket should have been removed when the three men entered the bucket to be lowered.

The man, of Greybull, Wyoming, was visiting the site about 30 miles north of Evansville as part of a 30th anniversary celebration of the merger that formed the company. He founded Frontier Construction in 1965 and the companies merged in 1977.

A report by the Indiana Bureau of Mines and Mine Safety in March found that the bucket carrying the men had traveled about 20 feet when the sling became wedged in a door and tipped the bucket. The men died of blunt impact trauma.

Originally posted at InjuryBoard by Chrissie Cole

Nursing Homes Partially-Owned by State Legislator Cited

Recent problems found at nursing homes partially owned by Rep. Doug Cox are bothersome and part of a bigger problem concerning nursing home legislation, said the Executive Director of the Oklahoma Center for Consumer and Patient Safety.

While it wasn't the worst of cases, the fact that they have significant deficiencies gives rise for the potential for nursing home abuse and/or negligence.

The director has been critical of this legislative session for stripping Senate Bill 1459 of a requirement that all state nursing homes carry $250,000 of liability insurance.

The Oklahoma State Department of Health found problems at nursing homes in Fairland and Kingston that ranged from failing to have a registered nurse on staff and giving residents the wrong medication to lesser lapses such as employees without name tags, the homes' inspection records show.

The homes were cited for 14 and 12 deficiencies, respectively, which is more than the statewide average of eight yearly deficiencies, according to Health Department records. The problems have since been fixed.

Health Department officials as well as a doctor, whom oversees medical operations at the homes, said similar problems have been surfacing at other state nursing homes.

The problems discovered at Cox's homes weren't immediately threatening to the residents, said chief of long-term care for the state Health Department.

Originally posted at InjuryBoard by Chrissie Cole

San Francisco Medical Malpractice Case Settled for $5M

On Tuesday, San Francisco supervisors approved a $5.1 million dollar settlement that stems back to a 2005 medical malpractice incident that occurred at San Francisco General Hospital.

The settlement is the largest in recent memory that involves a medical malpractice case, according to a spokesman for City Attorney.

The city admitted to mishandling the case of John Weatherspoon III, who visited the hospital on June 2005 complaining of fever and cough symptoms that had persisted for over a week, according to documents filed in San Francisco Superior Court.

Medical staff determined Weatherspoon, who was 40 at the time, was suffering from acute renal failure and gave him sedatives, according to the court documents. The hospital staff then allegedly failed to monitor Weatherspoon following successive doses of sedatives and he suffered cardiorespiratory failure and was "down for nine minutes," according to a medical examination included in the court documents.

As a result, Weatherspoon suffered anoxic brain injury and now requires 24-hour care. He stayed at the hospital until February 2006, when he was transferred to Laguna Honda Hospital, where he remains.

Damages sought - initially $10 million - are to be used to pay for home care for the duration of his life. He will receive $4.2 after paying fees and expenses associated with the settlement.

Previously, he settled a suit with the University of California for $250,000. San Francisco General Hospital is staffed by UCSF physicians; other staff personnel are city employees.

The Mayor must still approve the settlement. The city's office would not comment on the settlement in further detail.

Originally posted at InjuryBoard by Chrissie Cole

Woman Killed in Car Accident in South Tulsa

A woman was hit and killed in car accident on a busy street in South Tulsa. The woman was trying to cross the street near Riverside Drive when she was struck by a passing motorist late Wednesday night, according to Tulsa police.

The driver of the vehicle told the police he did not see the woman until it was too late. The impact of the crash knocked the woman on the ground. Police say the woman was cited in a fender bender and was crossing the street to Blockbuster to call a cab. She was crossing back to her vehicle when she was struck by the car.

Alcohol does not appear to be a factor in the crash, according to Tulsa police. The driver is not currently facing any charges at this time.

Originally posted at InjuryBoard by Chrissie Cole
